12-hour vehicle impound for all DUI arrests passed by Washington State Legislature

If the Governor signs it, the law just gets tougher for those arrested for DUI or Physical Control in Seattle or anywhere in Washington State. The added cost to each person arrested could be between $250 - $600 in Towing and Impound fees depending on where you live in Washington.  Not to mention all the constitutional legal issues this law raises. I can foresee this law being challenged on those grounds by Washington State DUI and criminal defense attorneys.

Can I be DUI on a prescription?

Yes. Recently, I have seen an increase in arrests for Washington State DUI or Physical Control involving prescription drugs or combination of prescription drugs and alcohol. This reminded me again the hazards and perils of prescription medications and driving  - and how the public doesn’t associate prescriptions with DUI’s. Over the years, I have represented many people for prescription drug DUI’s including oxycontin, ambien, zanac, prozac and percocet among others. Although, I managed to get a good resolution (obtain a reduced charge or dismissal) in every case, it still was a very costly and traumatic experience for the ones involved. 

Remember, a valid prescription is not necessarily a Defense to DUI. 

 

Does the Interstate Compact apply to my DUI case?

Maybe. The Interstate Compact allows you to transfer your probation to another State if you move or change jobs. You will be required to contact your probation officer or the court if there is no probation department, to request permission to travel or transfer to another state if placed on probation for one (1) year or more and the crime involves a second or subsequent misdemeanor offense of DUI or Physical Control. (this included deferred prosecutions)

New Ignition Interlock Device requirement likely for Reckless/Negligent Driving in State of Washington.

If Governor signs Bill 1789 into law it will require an Ignition Interlock Device for 6 months on subsequent reckless and negligent driving convictions. The Bill has already passed the State House and Senate. This will only apply to those with a previous DUI/Physical Control or reckless/negligent driving (reduced from DUI) conviction within 7 years. It doesn't apply to first offenses.

Should I do a Deferred Prosecution on my 1st DUI or Physical Control Charge?

Probably not. Usually, I would recommend against entering a deferred prosecution on a first offense DUI. In Washington State you get one opportunity to do a deferred prosecution in your lifetime and typically I advise against it. However, there are exceptions, many clients have little choice because of personal, career or employment considerations. I have had doctors, lawyers, executives, police officers and other professionals enter into a deferred prosecution on a first offense, especially when a DUI conviction was not an acceptable option. Often, with these clients, a reduction even to reckless or negligent driving is still an unsatisfactory resolution. I also do not like a deferred prosecution because like a DUI conviction it has a five year probationary period - whereas reckless and negligent driving the maximum probationary time period is two years. Obviously, you must still meet the eligibility requirements of a deferred prosecution. However, every person's situation is unique and you should consult with a Seattle or Washington State DUI attorney to find the best option for you.
