Are DUI Payment Plans available?

Yes, we understand today’s extremely uncertain economic climate and that sometimes it is difficult to pay the entire legal fee (or even 50%) in advance as most DUI attorneys in Washington require.

At Kotlowski Law Office PLLC, we can make payment arrangements on your Washington State or Seattle DUI case and will do our best to work with each client’s unique financial situation. (down payments as low as $1000 have been accepted to start your payment plan) Monthly Payments typically range from $250-$500 a month.

My driver's license was punched because of my DUI arrest - can I drive?

Yes, as long as you were not suspended for anything else at the time of your arrest for DUI or Physical Control. In Washington State your license is still valid for 60 days from the date of your arrest. However, it is considered a temporary license and you are supposed to tear off and carry around the bottom portion of the form that is also the Department of Licensing (DOL) hearing request.

The police officer or trooper should have given you a Washington State DOL hearing request. If you follow the instructions and timely request a DOL Hearing within 20 days - your temporary license is extended until the Washington State Department of Licensing Hearing Officer issues a decision. 

How many days do I have to request a Department of Licensing Hearing after my DUI arrest?

You have 20 days from the date of your arrest for DUI or Physical Control in Washington State to request a Department of Licensing hearing. If you do nothing your license will be suspended 60 days from the date of your arrest.

You can request a hearing online at: (https://fortress.wa.gov/dol/hrpo/) or by mail (my preferred method) and must include $200.00 unless you qualify for a waiver. This is a civil administrative proceeding with the Department of Licensing and is irrespective of if - or - when criminal charges are filed. You should receive a letter from the Washington State Department of Licensing titled "Order of Suspension". The length of your suspension will depend on your prior DUI/Physical Control administrative and criminal history.   

 

Can I vacate or expunge my DUI conviction in Washington State?

No. Unfortunately, it is on your record for life. 99 years for the Department of Licensing. If you had it reduced or amended to Reckless or Negligent Driving it can be vacated - 3 years after the case is closed - if you meet certain conditions. Stay tuned for more on this topic this fall.
