Most Washington State and Municipal Courts will allow a DUI or Physical Control Deferred Prosecution Treatment Program to be completed out of state as long as it complies with Washington State's Deferred Prosecution Treatment Program requirements in the RCW's and the WAC's. I have clients complete the alcohol/drug evaluation at a Washington State approved chemical dependency treatment agency and then have the out of state treatment agency follow that plan exactly. The out of state agency will have to complete a Commitment to Provide Treatment and that will have to be submitted with the Deferred Prosecution Treatment Plan to the Court. Also, you may be subject to the interstate compact if this is your second or subsequent DUI or Physical Control. You should check with your attorney on the latter.
