No. You do not get any type of credit for the SCRAM device because it is not considered custody. Alot of Judges are now requiring SCRAM at DUI Arraignment as a condition of release on second or subsequent DUI offenses. (especially within 7 years) EHM (electronic home monitoring) may be a better option as a condition of release because the Court may give you credit toward any of the EHM Mandatory Minimums if convicted of a second or subsequent offense DUI. Obviously, EHM is more restrictive and may not a better option for some defendants awaiting resolution or Jury Trial in their DUI case.
